Your agreement with OctivRx

These Terms of Use govern your use of the OctivRx website and its search, pharmacy-location, card-preview, and inquiry features. The website is operated by Octiv Health, Inc., a Pennsylvania company in the United States (“OctivRx,” “we,” “us,” or “our”).

Please read these Terms before using the website. By using it, you agree to these Terms. If you do not agree, do not use the website. A form may also require an affirmative agreement before submission. Our Privacy Policy describes information handling; it is not consent to marketing.

Eligibility and authority

You must be at least 18 years old and legally able to enter into this agreement. If you use the site on behalf of a pharmacy, employer, or other organization, you must be authorized to do so. Provide accurate information and do not impersonate another person or organization.

The website does not currently require an account for medication or pharmacy searches. Do not submit another person’s confidential information through the partner form.

What the website provides

The website provides medication-catalog information, location-based pharmacy discovery, illustrative prescription-price comparisons, savings-card previews, and a way to inquire about business partnerships. Searching and viewing a card do not require payment to OctivRx.

OctivRx is not insurance, a pharmacy, or a healthcare provider. The website does not pay pharmacies, adjudicate insurance claims, dispense medication, or establish a clinician-patient relationship. Any separately offered healthcare or paid service would require its own terms before use.

Features are available only when they are operational. Card email is available as a one-time request; acceptance by the email provider does not guarantee inbox delivery. Physical-card requests and text-card delivery remain unavailable. An email, download, form entry, or failed submission does not create valid pharmacy-processing credentials, a fulfilled physical-card order, a subscription, or a marketing enrollment.

Prices, pharmacy participation, and card previews

Prices labeled Preview price or otherwise described as illustrative are examples, not live pharmacy quotes. They do not verify medication stock, pharmacy participation, OctivRx acceptance, or what you will pay. Current sample card processing numbers are not valid for pharmacy use; do not present a preview card as an operational discount credential.

Savings vary by medication, quantity, location, and pharmacy. An “up to” savings statement describes a possible maximum, not a guarantee. Before paying, confirm any actual offer, participation, availability, final cash price, and pharmacy requirements directly with the dispensing pharmacy.

A prescription-discount program is not insurance and generally cannot be combined with insurance for the same purchase. Ask the pharmacy or your insurer about insurance pricing, deductible treatment, and any restrictions. You are responsible for payment for medication you purchase.

Not medical advice

Medication listings and search results are informational and may be incomplete or outdated. They are not a diagnosis, prescription, treatment recommendation, or advice about changing a medication, dose, form, or quantity.

Always confirm prescription details and medication decisions with a qualified prescriber or pharmacist. Do not delay care because of information on this website. For an emergency, call 911 or your local emergency number.

Location and third-party information

Map, pharmacy, contact, hours, and routing information comes from external sources and may contain omissions or errors. Store hours may differ from pharmacy-counter hours. Driving distances are estimates; a result labeled straight-line distance is not a driving estimate.

You control device-location permission in your browser and may enter a location manually. Third-party websites, maps, pharmacies, and healthcare services have their own terms and privacy practices. Linking to a service or displaying its name does not guarantee its accuracy, participation, or endorsement.

Business inquiries and communications

The partner form is for pharmacy and organization inquiries, not patient care. Do not submit medical records, patient identifiers, payment information, or other sensitive information. You retain rights to your submitted content and authorize us and necessary service providers to process it only to handle your inquiry and related obligations.

An inquiry does not create a partnership, pharmacy-network agreement, contract for services, or marketing subscription. Any partnership requires a separate agreement.

A successful submission means the email service accepted the inquiry for delivery; it is not a guarantee that it reached an inbox or has been read. If delivery cannot be confirmed, the form reports that condition rather than success. Contact support@octivrx.com for another way to communicate. Ordinary email is not a secure patient portal.

Acceptable use

Use the site lawfully and without interfering with others’ access. In particular, you must not:

• Submit fraudulent inquiries, impersonate others, transmit malware, send spam, or use the website to harm people.
• Attempt unauthorized access, circumvent security or rate limits, or overload the site or its providers.
• Use automated access that disrupts the website or violates applicable provider terms or law.
• Misrepresent a preview price as a live offer or an invalid preview card as a valid processing credential.
• Infringe another person’s rights or submit confidential patient information through the business form.

Content and intellectual property

OctivRx branding, website design, software, and original content belong to Octiv Health, Inc. or the applicable rights holders. You may use the website and save a card preview for your own lawful, noncommercial reference, subject to these Terms. This does not grant rights to trademarks or permit misleading use of card details.

Medication data, pharmacy names, logos, map content, and third-party materials remain subject to their owners’ rights and applicable terms. The open license for the legal text identified below does not license OctivRx trademarks, software, or third-party content.

Availability and disclaimers

We may maintain, change, suspend, or discontinue features, including when necessary for security, provider changes, or legal compliance. We do not guarantee uninterrupted access, a response time, a particular level of savings, or the accuracy or completeness of third-party data.

To the extent permitted by law, the website and its informational features are provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

Limits of liability

To the extent permitted by applicable law, we are not liable for indirect, incidental, consequential, special, or punitive losses arising from use of the website, such as lost profits or losses caused by reliance on illustrative prices or third-party information.

To that same extent, our total liability for claims arising from the website will not exceed the greater of $100 or the amount you paid us for the relevant website service during the preceding 12 months. The current website search and card-preview features are free.

These limits do not apply where prohibited by law, including liability that cannot legally be limited for fraud, willful misconduct, or other non-excludable obligations. Your mandatory consumer protections remain intact.

Restrictions and ending use

You may stop using the website at any time and clear stored browser preferences. We may restrict access reasonably necessary to address violations of these Terms, security threats, misuse, or legal requirements. This does not cancel a separate agreement with a pharmacy or healthcare provider.

Provisions that by their nature must continue, including intellectual-property protections, applicable disclaimers, liability limits, and dispute provisions, continue to apply where legally enforceable. Privacy requests remain available under our Privacy Policy.

Governing law and disputes

These Terms are governed by Pennsylvania law, without its conflict-of-law rules, except where your applicable mandatory consumer law requires otherwise. Subject to those mandatory protections, disputes may be brought in the state or federal courts with jurisdiction in Pennsylvania.

We encourage you to contact support@octivrx.com first so we can try to resolve a concern. These Terms do not impose mandatory arbitration, waive class actions, or prevent you from exercising non-waivable legal rights.

Changes, general provisions, and contact

We will post updated Terms and a revised date on this page. Material changes will receive additional notice when required by law and will not apply retroactively to resolve an existing dispute. If you do not agree to updated Terms, stop using the affected service.

If a provision is unenforceable, the remaining provisions continue to the extent allowed by law. Failure to enforce a provision immediately is not a waiver. These Terms cover use of this website, not separately signed partnership or healthcare agreements.
